Terms of Service.

1. Contracting party and scope

These terms apply to services supplied by [LEGAL COMPANY NAME], trading as LemonHosting, registered in the Netherlands under KvK number [KVK NUMBER], with registered office at [REGISTERED ADDRESS] ("LemonHosting", "we" or "us"). They apply to hosting, GamePanel access, billing services, support, migration assistance and related digital services.

2. Orders and account

You must provide accurate account and billing information and keep your credentials secure. A contract is formed when we accept your order and payment or otherwise confirm the service. You must be at least 16 to use the service independently, or have permission from a parent or legal representative where required.

3. Prices, VAT and payment

Prices are shown in euros and include or exclude Dutch VAT as stated at checkout. The billing period and renewal price are shown before purchase. Invoices must be paid by the due date. We may suspend a service after notice if an invoice remains unpaid.

4. Consumer cancellation

If you are a consumer in the Netherlands or EU, you normally have a 14-day right of withdrawal for a distance contract. If you ask us to start providing the digital hosting service during that period, you expressly request early performance. Once the service has been fully performed, or where the statutory exception for digital content not supplied on a tangible medium applies after your prior consent and acknowledgement, the withdrawal right may end. Any mandatory statutory consumer rights remain unaffected.

5. Acceptable use

You may not use the service for unlawful content or activity, malware, phishing, credential theft, spam, harassment, copyright infringement, attacks, crypto-mining without written permission, or activity that disrupts the infrastructure or other customers. You remain responsible for your worlds, files, plugins, mods, users and server content.

6. Resources and fair use

Each package includes the RAM, CPU allocation, storage and features stated on the package page. We may ask you to correct sustained resource abuse, upgrade to a suitable package, or move to a dedicated solution. We will consider the circumstances and provide reasonable notice where practical.

7. Availability and maintenance

We aim to provide reliable service but do not guarantee uninterrupted availability unless a separate written SLA applies. Maintenance, security work, upstream incidents and events outside our reasonable control may affect availability. We will communicate planned or material incidents where practical.

8. Backups and migration

Backups and migration assistance are provided according to the selected package. You remain responsible for maintaining independent copies of important data. Migration timing depends on the source host, data size and access provided to us. We will handle customer data only as necessary to perform the requested service.

9. Suspension and termination

We may temporarily suspend access to protect the service, investigate abuse, address security risks or respond to non-payment. We may terminate for a material or repeated breach. Where legally required, we will provide notice and an opportunity to remedy the breach. You may terminate recurring services through the Billing Area, subject to outstanding charges and any applicable statutory rights.

10. Intellectual property

You retain rights in content you upload. You grant us the limited rights needed to host, copy, transmit, back up and technically process that content to provide the service. LemonHosting software, branding, documentation and website content remain our property or that of our licensors.

11. Liability

Nothing in these terms limits liability where limitation is not permitted under Dutch law, including liability for intent or deliberate recklessness, death or personal injury caused by our conduct, or mandatory consumer rights. Subject to that, our liability is limited to direct loss and, for a recurring service, the fees paid for that service in the three months before the event giving rise to the claim. We are not liable for indirect loss, lost profits, lost data where independent backups were reasonably available, or consequential loss to the extent permitted by law.

12. Complaints and applicable law

Contact us through the LemonHosting Discord first so we can investigate a complaint. These terms are governed by Dutch law. If you are a consumer, the courts that have jurisdiction under mandatory consumer law remain available to you. For other disputes, the competent court in the Netherlands will have jurisdiction, subject to mandatory law.

13. Changes

We may update these terms for legal, technical or operational reasons. We will give reasonable notice of material changes. Changes do not affect rights that already accrued before the effective date.
